For those of you who know about the eBay/BoR situation: eBay members keep offering illegal copies of Beats of Rage, others keep complaining and eBay keeps looking the other way.

But apparently eBay thought it necessary to piss us off even more, as what did I see on Google today? An eBay ad offering BoR for sale! This is just too much!

As a U.S. citizen, my first suggestion would be to sue them, as that's what our country is built on.

Seriously, though, I don't think there's all that much you can do if eBay won't cooperate. Despite my memories to the contrary, I can't find any sort of license for BoR listed anywhere in the download. If you do have some kind of license, that will probably give you the leverage to at least threaten legal action, even if you don't intend to bring it.
Not having ever gotten one myself, I'm not sure what options you have for getting a license/copyright/etc. You may want to check the open-source licenses like GNU, CC, etc. for information.
The fact that BoR uses copyrighted graphics may weigh against it. If that's the case, you may not be able to do anything (legally, anyway). That won't be a problem for AotB, so if you get the chance you may want to look into some kind of intellectual protection for AotB before it's release.

Well people are able to sell roms (sega, nintendo, mame) on ebay that are copywritten then there isn't much hope for bor on ebay.

it really sucks for you guys though. you couldnt sell it but other people can just go around making a buck of it, and that aint right. here you guys made the game (well the engine at least) and every one but senile team is making profit. damn those people.

but the good news is when i did a search on ebay for beats of rage, only one was up for sale. (3.90 in american cuurency) but i reported it as fraud.

Actually, they can't sell it either for the same reason Senile Team can't: it contains copyrighted material, and nobody's been given permission to use that material. The auctions are indeed illegal.

Hi mr roel.  have been a fan of BOR since it first came out.. and to see these fools rip off your work really pisses me off. I actually came across a listing on ebay by an ebay member by the name of "nwm666", I filed a complaint with ebay to see if they would take action.. no word from they yet. so I decided to further investigate this guy.. it seems like he rips all freeware off and sells them for a profit. I say we expose this fraud!.
